This procedure is legally known as a 1203.4 Dismissal. This is because Section 1203.4 of the California Penal Code allows individuals who have completed their sentence for a DUI, or other qualified Vehicle Code violation, to petition to have their case dismissed. If the petition is granted, the court will permit the individual to withdraw their plea of no contest or guilty. In addition, if the individual was convicted, the court will set aside the guilty verdict and dismiss the accusations against the individual. The result is that the offense will not appear on most employment background checks and you will be legally entitled to answer “no” when asked on an employment application if you’ve ever been convicted of a crime.

In order to be eligible for a California DUI expungement under California Penal Code Section 1203.4, you must meet the following criteria:

  1. You have completed your probation
  2. You do not have any pending charges against you or are serving any other sentence when you file for the expungement
  3. You have paid all of your court-ordered fines and fees

Lastly, you are not eligible to expunge your DUI in California if you went to state prison.

Once your past DUI criminal record is expunged, you can say truthfully that you were not convicted. However, there are three narrow circumstances when your conviction must be disclosed:

  • If asked on application or questionnaire for public office
  • When getting a license from a local or state agency, and
  • When contracting with the California State Lottery Commission

Please note your conviction may still be considered by the DMV in revoking or suspending your driver’s license.

  • Eluding a police officer in disregard for the safety of persons or property OR causing bodily injury (Vehicle Code 2800.2 and 2800.3)
  • Crossing over the median on a highway (Vehicle Code 21651(b))
  • Driving a vehicle at a speed greater than 100 miles per hour (Vehicle code 22348(b))
  • Motor vehicle speed contest or race or exhibition of speed whether or not it causes injury (Vehicle code 23109(a or c) and 23109.1)
  • Unlawful transportation of explosives (Vehicle Code 31602)
  • Person under age of 21 driving under the influence of alcohol (Vehicle Code 23140(a or b)), and
  • Driving on a suspended/revoked license (Vehicle Code 14601, 14601.1, 14601.2, 14601.3, or 14601.5).
